Article 90.4: Enforcement

(A) Application

The NEC is designed for mandatory application by governmental bodies with legal jurisdiction over electrical installations, including signaling and communications systems. It is also intended for use by insurance inspectors to ensure compliance and safety.


(B) Interpretations

The authority having jurisdiction (AHJ) is responsible for:

  • Interpreting the rules of the Code.

The AHJ has the authority to:

  • Waive specific requirements of the Code.

(D) New Products, Constructions, or Materials

The Code may reference new products, constructions, or materials that are not yet available when the Code is adopted. In such cases:

  • The AHJ may allow the use of products or materials that comply with the most recent previous edition of the Code adopted by the jurisdiction.

This provision ensures that advancements in technology and materials are not hindered by the timing of Code updates.
